Carepod Creator Agreement

Thank you for joining our community at Carepod!

Below is a document that clarifies the terms under which You, the person listed below, may create and post material on your social media profiles and/or website that share your experience with Carepod products (“Creative Work”) for Carepod US, Inc. (“Carepod”). We appreciate your participation in our community, and your help in spreading the word to your audiences about happier living through better breathing!

Please carefully review the Agreement below. By signing up through our Shopify Collabs page, you’re confirming your agreement to the terms outlined.If you have questions about these terms, please contact our team at community@hellocarepod.com. 

In consideration for payments related to your Creative Work, you agree to the following terms and conditions:

  1. The term “Creative Work” means all of the material created and posted to your social media profiles sharing Carepod products in exchange for agreed-upon payment. 

  2. You agree to the following: 

    • Create and share Creative Work in the form of the following: 1 in-feed Reel/Video + 1 Story that is shared to your Instagram, TikTok, and/or YouTube account, featuring the Carepod product(s); or any content specified or mutually agreed-upon in conversations with any representatives of Carepod. 

    • Creative Work must be published within 14 days of receiving the product, unless otherwise agreed upon in writing.

    • Include, when sharing: 

      1. Tag @hellocarepod in the caption and/or within the video or content asset 

      2. Use of hashtags: #mycarepod (optional)

      3. Affiliate URL or code, provided by us

      4. Disclosure: Please make sure to include a clear disclosure in your content. This can be done using hashtags such as #sponsored, #promo, or #ad. Alternatively, you can also state directly in the video or caption that you received a complimentary product from us to try. 

    • Submit photo(s) and video(s) to community@hellocarepod.com, along with raw versions of each, or upload to our provided Dropbox folder, prior to or at the time of publishing, unless otherwise agreed. 

    • Submit a screenshot of engagement statistics featuring the impressions and clicks produced by each post, story, and/or published content piece to community@hellocarepod.com.

  3. You will receive a free Carepod humidifier gift. You will receive commission according to the agreed percentage of net sales generated through your affiliate code or link. Commissions are subject to a 30-day holding period and are paid out on a rolling basis via Shopify. Please allow additional days for Shopify to process the payment.

  4. Creative Work must be original and compliant with the terms and conditions of the social media platforms used. Carepod reserves the right to request edits or removal of any Creative Work that is inaccurate, misleading, or not aligned with brand guidelines. You agree to make reasonable efforts to revise or remove such content within 3 business days of receiving written notice.

  5. You agree that nothing contained in this Agreement shall be taken to establish any partnership, joint venture, or employment relationship. 

  6. You are granted the right to use and publish Creative Work for marketing purposes; and the right to perform the services publicly. By participating, you give Carepod permission to feature and share your content across our marketing channels, including but not limited to our website, social media, ads, and emails. This license is non-exclusive, royalty-free, and allows us to use your content, in full or in part, to help others learn about Carepod.

  7. You agree to treat private information such as strategies, PR and campaign and content plans, that may be provided by us during the term of this Agreement as strictly confidential. All such confidential information exchanged between us, shall be used solely for the purposes of rendering services pursuant to this Agreement and, shall not be disclosed to any third party without the prior written consent of either of us.

  8. You agree not to share, distribute, or upload affiliate codes or coupon links to third-party discount or deal aggregation websites. In the event that codes are found on such sites, we reserve the right to take appropriate measures to have them removed in collaboration with the respective platforms. Additionally, a new discount code will be issued as necessary.

  9. In no event will you or Carepod have any liability for any claim, whether in contract, tort or any other theory of liability.

  10.  Either party may terminate this Agreement at any time with written notice after agreed-upon content is delivered. Upon termination, Carepod reserves the right to deactivate your affiliate code or link.

  11. This agreement applies to all content created in affiliation with Carepod, including content produced for both initial and any subsequent collaborations.
