1. Welcome to Carepod

This website and its localized storefronts are operated by CarepodUS Inc., trading as Carepod and hellocarepod ("Carepod," "we," "us," or "our"). These Terms apply when you browse our website, create an account, or place an order.

By using the website or purchasing from us, you agree to these Terms and the policies linked here, including our Privacy Policy, Shipping Policy, Return and Refund Policy, and Warranty Policy. If you do not agree, please do not use the website or place an order.

Nothing in these Terms takes away consumer rights that cannot legally be excluded. If a mandatory consumer law where you live gives you additional rights, those rights still apply.

2. Using our website

You must be legally able to enter into a purchase agreement in your location. Please use the website only for lawful, personal shopping and informational purposes.

Do not misuse the website, interfere with its security, upload harmful code, scrape or collect information unlawfully, impersonate someone else, commit fraud, or infringe another person's rights. We may restrict access where reasonably necessary to protect customers, our website, or our legal rights.

3. Product information

We do our best to make product descriptions, photographs, specifications, prices, and availability accurate. We may correct typographical errors, inaccuracies, or omissions and update product information when needed. Colors, packaging, and small product details may vary slightly because of screens, photography, manufacturing updates, or regional configurations.

These small variations do not affect your rights if product information was materially inaccurate or misleading or if a product is faulty, unsafe, materially different from its description, or otherwise does not meet applicable consumer guarantees. Product availability is not confirmed until we accept your order.

4. Prices and payment

Prices are displayed in the currency shown on your localized storefront. Before you submit an order, checkout will show the product price and any applicable taxes, shipping charges, duties, or other charges known to us.

Prices may change before an order is placed. A price change will not affect an order we have already accepted, except where there is an obvious pricing error and the law allows us to cancel. If that happens, we will contact you and refund any amount charged.

Payments are processed by the payment method or provider selected at checkout. Financing and buy-now-pay-later options, including any interest, fees, eligibility requirements, or payment schedules, are provided under the separate terms shown by the relevant provider. 

5. Orders

Placing an order is an offer to buy. We will first send an order acknowledgement. Unless local law says otherwise, we accept the order when we send a shipping confirmation or otherwise clearly confirm acceptance.

Before submitting your order, please review the products, quantities, delivery address, payment details, and total price. We will send an electronic confirmation that you can save.

We may decline or cancel an order because of suspected fraud, payment failure, stock issues, shipping or legal restrictions, purchase-limit violations, or an obvious pricing or product-information error. If we cancel an order after payment, we will notify you and issue a refund.

6. Shipping and delivery

Available destinations, shipping costs, and estimated delivery times are shown at checkout and explained in our Shipping Policy. Delivery estimates are not guarantees unless we specifically say they are, but we will follow any deadlines required by law.

We are not responsible for delivery delays caused by events outside our reasonable control, such as severe weather, carrier disruptions, government actions, or similar events. This does not affect any cancellation, refund, or other rights available to you under applicable law.

If an order is delayed, we will provide any notice, cancellation option, consent request, or refund required by applicable law. Risk of loss passes at the time required by local law. For UK consumers, this will generally be when you or someone you identify physically receives the goods.

7. Returns, cancellations, and refunds

Our Return and Refund Policy explains our voluntary return program and how to request a return. It does not replace your legal rights if a product is faulty, unsafe, misdescribed, delayed, or otherwise does not meet applicable requirements.

We offer customers 30 days from the date their order is delivered to request a return. Once a return is approved, customers must follow the instructions and timelines provided in our Return and Refund Policy. Certain exceptions may apply, including to sealed products that cannot be returned after opening for health or hygiene reasons. This 30-day return policy is provided in addition to any cancellation, refund, or consumer rights available under applicable law.

Approved refunds will be issued to the original payment method unless another method is agreed or required by law. Refund timing and any refund of standard delivery charges will follow applicable law.

8. Carepod warranty

Carepod provides the following limited warranty coverage beginning on the original purchase date:

  • United States, Canada, and Australia: one-year limited warranty for the main Carepod unit and two-year limited warranty for the oscillator.

  • United Kingdom: two-year limited warranty for both the main Carepod unit and the oscillator.

The limited warranty covers eligible manufacturing defects under normal use. Our Warranty Policy explains what is covered, what is not covered, how to submit a claim, what information is required, and who is responsible for claim-related costs.

This warranty is provided in addition to your rights under applicable consumer law. It does not replace or limit those rights, and the end of the written warranty period does not necessarily mean that all statutory rights have ended.

9. Product care and safety

Please follow the product manual, cleaning instructions, safety information, and intended-use guidance supplied with your Carepod. Information on our website is provided for general product and informational purposes only and is not medical advice or a substitute for advice from a qualified healthcare professional.

Please use, clean, and maintain the product only as described in the instructions and safety information provided with it.

Stop using the product and contact us if you notice damage, overheating, electrical irregularities, contamination, or another safety concern. Nothing in this section limits rights relating to a defective or unsafe product.

10. Accounts

If you create an account, keep your login information secure and let us know if you suspect unauthorized access. We may temporarily restrict an account for security, fraud prevention, or legal compliance. This will not remove rights connected with an existing order, refund, return, or warranty claim.

11. Third-party services and links 

Our website may use third parties for payments, financing, shipping, warranties, analytics, or other services. Their own terms may apply when clearly disclosed. We may also link to independent websites. We do not control and are not responsible for independent third-party websites, services, content, or practices. A link or integration does not mean that we endorse or guarantee that third party.

This does not remove any responsibility Carepod has for fulfilling your order or for service providers acting on our behalf where the law makes us responsible.

12. Reviews and feedback

You keep ownership of the content you submit. You give us a non-exclusive, royalty-free licence to use, adapt, publish, and display it only as reasonably needed to operate, improve, and promote Carepod, subject to our Privacy Policy and applicable law.

By submitting content, you confirm that you have the right to share it and that our permitted use of it will not infringe another person's rights. It must not be unlawful, misleading, abusive, infringing, or malicious. We may remove content for legitimate legal, safety, authenticity, or policy reasons. If a review received an incentive, we will disclose it where required.

13. Our website content

Carepod's branding, product designs, website, software, text, images, and other content are owned by or licensed to us and protected by intellectual-property laws. You may use the website for lawful, personal shopping and information, but you may not copy, sell, exploit, or republish our content without permission or another lawful basis.

14. Privacy and communications

Our Privacy Policy explains how we collect and use personal information. We may send transactional messages needed to manage orders, accounts, product-safety notices, warranties, and customer support. Marketing communications will follow applicable consent and unsubscribe requirements.

15. Website availability and liability

We work to keep the website available and accurate, but we cannot promise that it will always be uninterrupted or error-free. This website-availability statement does not apply to product quality or safety, or to our obligations under an accepted order.

Nothing in these Terms excludes or limits liability for fraud, personal injury or death caused by negligence or a defective product, mandatory consumer guarantees, or any other liability that cannot legally be excluded.

Where the law allows liability to be limited, we are not responsible for losses that were not reasonably foreseeable when the purchase agreement was formed or for business losses suffered by someone purchasing as a consumer. To the extent permitted by law, we are not responsible for losses caused solely by temporary website outages, technical errors, or your reliance on general informational content on the website.

16. Suspending access

We may restrict or stop access to the website if we reasonably believe this is necessary because of fraud, unlawful conduct, a security risk, a serious breach of these Terms, or a legal requirement. Where practical and lawful, we will provide notice and an explanation.

Restricting website access does not cancel rights connected with an existing order, payment, refund, return, warranty, product-safety issue, or dispute.

17. Governing law and resolving concerns

These Terms and any purchases made through our website are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. However, this choice of law does not limit any mandatory consumer rights available to you under the laws of the country, state, province, or territory where you normally live.

If you have a concern, please contact us first at support@hellocarepod.com so we can try to resolve it. Nothing in these Terms prevents you from contacting or bringing a claim before any court, regulator, ombudsman, consumer-protection agency, or dispute-resolution service available to you under applicable law.

18. Changes to these Terms

We may update these Terms when our services, operations, or legal obligations change. The latest version and effective date will be posted here. Material changes affecting an account or continuing service will be communicated where required.

Updates apply going forward. They will not normally change the terms of a purchase we already accepted unless you agree or the law requires the change.

If any part of these Terms is found to be invalid or unenforceable, the remaining Terms will continue to apply.
